Eligibility for Employment Visa

Foreigners must meet the following requirements to be employed in China:

  1. Be at least 18 years old and in good health.
  2. Have the necessary professional skills and corresponding work experience to perform their job.
  3. Have no criminal record.
  4. have a known employer for employment
  5. Hold a valid passport or other international travel documents.

 

Foreigners who intend to work in China with a Z visa are required to obtain an Employment Permit for Foreigners and a Residence Permit for Foreigners after entering the country. As for the family members of foreigners employed in China, including spouses, parents, and underage children, they are required to present proof of kinship, the working person’s passport, visa (residence permit), the Employment Permit for Foreigners, and other documents proving their work at the time of application.

 

Application for Employment Permit for Foreigners

Entities wishing to employ foreigners are required to fill out the Application for Employment of Foreigners and provide the following valid documents:

  1. Proof of the curriculum vitae of the foreigner to be employed
  2. A letter of intent to hire
  3. A report of the reasons for the proposed employment of the foreigner
  4. A certificate of the health condition of the foreigner to be employed
  5. Other documents are required by laws and regulations.

 

Within 15 days after the entry of the employed foreigner, the employer is required to go to the original issuing authority to apply for an employment permit for the foreigner with the permit certificate, the labor contract signed with the employed foreigner, and his or her valid passport or substitute document, and fill in the “Employment Registration Form for Foreigners.”

It is worth mentioning that foreign-invested enterprises employing foreigners do not need the approval of the competent industry department and can apply for the permit certificate directly at the licensing authority of the labor administration department with the contract, articles of association, approval certificate, business license, and the documents mentioned above.
