Work Permit and Work Permit Application in China

China does not recognize dual nationality, and all people without Chinese nationality are considered foreigners. Foreigners working in China are required to apply for a work permit under the newly integrated policy “Work Permit for Foreigners in China,” now called “Notice of Work Permit for Foreigners” (previously called Foreigners Working Permit).

China Work Permit and Employment Pass Application

The application for a work permit is a key step for foreigners to legally work and live in China and to employ foreigners. The new policy classifies foreigners working in China into 3 categories: Category A (encouraged), category B (foreign professionals, controlled), and category C (foreign general personnel, restricted), and you must reach at least category C before we can assist you in applying for a foreigner work permit in China.

In general, companies wishing to hire foreigners need to apply for legal work permits (Notice of Work Permit for Foreigners and Work Permit for Foreigners) and work-type residence permits (Residence Permit for Foreigners) according to the following process.

    1. 1.1 Application for a work permit notice for foreigners
    2. 1.2 The foreigner takes the work permit notice to the Chinese embassy or consulate outside of China and asks for a Z visa.
  1. After getting a Z visa, the foreigner has three months to enter China and apply for a work permit for foreigners.
  2. Apply for a work permit for foreigners

 

Basic Requirements to Apply For a Work Permit in China

Regardless of which category A, B, or C they fall into, applicants must meet the following basic requirements:

  1. The applicant is at least 18 years old, in good health, and has no criminal record.
  2. There is a legal employer in China who can be found, and the applicant has the professional skills or degree needed to do the job.
  3. The applicant’s work meets the needs of China’s economic and social development.
  4. The applicant meets the requirements of Chinese laws and regulations for foreigners to work in China.

 

Documents to Be Prepared For the Application for a China Work Permit

  1. Application form for foreigners to work in China
  2. Proof of working qualifications
  3. Proof of professional qualification, highest academic certificate, or relevant approval document
  4. Official proof that the applicant does not have a criminal record from his or her country of birth or permanent residence.
  5. Certificate of medical examination of the applicant
  6. Employment contract, employment certificate, or dispatch letter
  7. Applicant’s passport or international travel document
  8. A recent photo of the applicant’s compliance
